‘We’, ‘Us’, ‘Our’ refers to instructors and officials as appointed by Paul Dent, as Head Instructor and Officer of PTD Enterprises Ptd. Ltd., as Trustee for P & T Dent Family Trust, ABN 99 319 362 744, trading as Pursuit of Wisdom Martial Arts Australia, or POW Marial Arts Australia.

‘You’ refers to the person entering into this agreement, and / or the parent or legal guardian of an individual.

‘Services’ refers to the range of services we offer to the development of martial arts skills in children, teens and adults for fun, fitness and self-defence, incorporating life skills, healthy habits, situational awareness and wellness teachings.

‘Email’ refers to electronic mail sent to Us in relation to our Services.

We are committed to your privacy, and will take all reasonable steps to ensure your personal information is collected, stored, transmitted and disposed of securely and responsibly.

Additionally, we intend to outline below to the best of our knowledge how technologies we use to provide Our Services manage your personal Information.

What We collect and why

Our Website and Email

Our Website and email services are hosted on Crazy Domains. We use Secure Socket Layer (SSL) Certificate technology to secure and encrypt information you may enter into a data collection form on the Website.

Emails are automatically redirected to our Google hosted email services.

No Personally Identifiable Information (“PII”) is stored on the Crazy Domains Web Hosting Service.

Website Data Collection Form

We need to collect specific member in order to provide provide the Service to You safely. This includes personal information like name, age, contact details, personal health and medical condition information, and any other information relevant to Us providing the Service.

We may use contact forms to collect information for a range of use cases. We use the WordPress plugin Contact Form 7 with Google ReCaptcha v3 technology.

No collected form data is stored on the Website.

Website Cookies

When you access the Website, WordPress may use small files called “Cookies” that may be stored locally on your device. This cookie may store information releted to your device, browser, IP address and other meta information automatically. The purpose of this cookie is to optimise your browsing experience, and to identify malicious website activity, such as attempts to hack the website. You can elect to not allow cookies when visiting the website, however this may diminish the user experience.

Google Analytics

We use Google Analytics to monitor website activity. Most information is aggregated and used to optimise for search engine optimisation (SEO) and user experience (UX).

Payment Information

We use Square POS as our Point of Sale Payment solution. It is PCI (Payment Card Industry) Compliant, and is not integrated with our Website or any other systems. Your payment card information is managed wholly within the Square POS solution.

IMPORTANT – DON’T GET SCAMMED!

  • As part of our processes, We do not write down, capture or store payment information outside of the Square POS solution.
  • Also, we will NEVER ask you for payment through other methods. If you ever receive an email or SMS requesting payment from Us, please ignore the request and call us immediately to discuss on 0468 477 951.

Photos, Videos and Social Media

From time to time, instructors may use photos or videos for coaching and promotional purposes. You agree we retain all royalty-free use and rights to these photos and videos for any and all use, including but not limited to print media, social media, email marketing, and website publication.

If for any reason you do not wish for a photo to be used, or would like a photo removed from our website or social media, please discuss with your instructor.

Data provided to a social media platform (e.g. recommendations, testimonials, posts, photos, videos or other content) may be re-used to promote our Services.

Your privacy responsibilities

We hire school facilities outside of school hours to conduct classes and gradings. As such, this makes it a private event, and any individual attending is subject to our terms and conditions. Specifically;

No photos or videos are allowed to be taken by parents, students or visitors during class or grading assessments without Our express permission.

This is to protect the right to privacy of others in attendance.

How We use Your data

We take your privacy very seriously. We take measures to ensure your personal data is stored securely, and only used for the purposes related to your membership to and participation in classes, events and other activities organised by Pursuit of Wisdom Martial Arts.

We use the following service providers to administer particular functions within Pursuit of Wisdom Martial Arts Australia, which will capture personal information for the purposes outlined below:

  • Square POS for electronic payments and receipts
  • Xero for accounting
  • Facebook for social media posting
  • Google AdWords and Google Analytics for SEO and marketing
  • Google services such as Google Forms, Google Drive, Gmail and Google Workspace applications for administration functions.
  • Microsoft services such as OneDrive and Microsoft 365.

Where required by law, we may be obliged to share or disclose your personal data with authorities.

How long we retain your data

This depends on the nature of the data. Different data is required to be kept for a longer period E.g. financial and taxation records are kept for 7 years.

Once we are satisfied we no longer require your data, we may archive or dispose of your personal data. Personal data on paper is shredded, burned, or disposed of in another secure manner. Any digital data may be archived or deleted.

What rights you have over your data

You can request to receive an copy of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Discosure of Your contact information

Your contact information will remain private unless required to be disclosed by law, emergency or safety reasons as deemed by Instructors.

Other reasons for personal information disclosure, we will seek your permission to share your information with a third party prior to disclosure.

An example of where we may seek your permission is when a student or parent tequests the contact details of another student. In these circumstances our preferred method is to pass on contact details from the requestor to You

Third Party Privacy Policies

Although we endeavour to protect your private information, we have limited control over the terms and conditions of other third parties. We recommend you review these terms and conditions before signing up.

How we protect your data

We secure files in password protected computers, cloud storage and Software-As-A-Service solutions. All paper based files are kept in our offices, retained for a period of time, and destroyed once retention periods have expired.

Access to all devices, accounts and services containing Your personal data are secured with strong passwords and multi-factor authentication, using biometric, device-based and/or authenticator app technologies.

What data breach procedures we have in place

In the event of a data breach, we will notify You as soon as possible. We will work with You and our suppliers where relevant to secure Your data on Our systems, as well as guiding you through the steps to manage the personal data breach. Depending on the scale, scope and severity of the data breach, We may engage IDCare, or recommend that You do so.
