Definitions

‘Agreement’ refers to the terms, conditions, responsibilities as outlined.

‘We’, ‘Us’, ‘Our’ refers to instructors and officials as appointed by Paul Dent, as Head Instructor and Officer of PTD Enterprises Ptd. Ltd., as Trustee for P & T Dent Family Trust, ABN 99 319 362 744, trading as Pursuit of Wisdom Martial Arts Australia, or POW Martial Arts Australia.

‘You’ refers to the person entering into this agreement, and / or the parent or legal guardian of an individual.

‘Services’ refers to the range of services we offer to the development of martial arts skills in children, teens and adults for fun, fitness and self-defence, incorporating life skills, healthy habits, situational awareness and wellness teachings.

‘Event’ refers to any gathering or activity that is initated, arranged, organised, run or managed by Us; including but not limited to regular classes, grading assessments, workshops, camps or specialised training, either in a physical location or online.

‘Private Venue’ refers to facilities owned or leased by Us, where You would not be otherwise authorised to be present. This includes but is not limited to the entire school grounds outside of school hours, even if We only hire part of the school (E.g. school hall).

‘Website’ refers to Our website – https://pursuitofwisdom.com.au.

Agreement

We have set out these terms and conditions to ensure that we can provide Our Services in a controlled environment that enables the best learning outcomes for students, whilst managing and minimising risk.

If You attend one of Our Events, or you wish to apply for mambership, You are subject to these terms and conditions. If you do not agree to these terms in their entirety, please do not attend the Event.

  1. Right to refuse entry to Private Venue – We reserve the right to refuse entry, or ask You to leave any Events held at a Private Venue, for any or no reason.
  2. Assumption of Risk – You have been provided, read and understood information regarding the Event, and understand that You attend and/or take part in the Event at your own risk.
  3. Parental Supervision <6yrs old – For students under 6 years old, is it the responsibility of the parent or guardian / carer to supervise their child whilst attending the Event.
  4. Follow Directions – You agree to comply with the rules and directions of Event officials, Instructors and their personnel.
  5. Marketing and Promotions – You hereby allow the use of your name and image for promotional and marketing purposes, and agree to your details being added to the Our Event database and Website. You also understand that You may be contacted via email by Us from time to time in regards to upcoming events and promotions.
  6. Health and Safety Risks – You are aware of the possibility of health and safety risks associated with participating in physical exercise and consent to any reasonable exercise which may from time to time be strenuous.
  7. Medical Clearance – We strongly recommend that all students consult an appropriately qualified medical specialist prior to commencing training with PURSUIT OF WISDOM Martial Arts.
  8. Disclosure of Medical Conditions – Please specify if you are aware of any existing or historical medical condition, family history, physical or mental disability, past or current injury that could potentially affect your involvement in this activity.
  9. Personal Protective Equipment – Whilst We are a non-contact club, accidents can happen. For this reason, We strongly recommend personal protective equipment, such as mouth guards, pads, head gear, gloves, arm and leg guards. You acknowledge sole responsibility for any personal equipment. You also consent to receive medical treatment which may be deemed necessary in the event of injury, accident or illness.
  10. Personal Insurance and Injury Cover – Please note we do not provide insurance cover for personal injury and you train at your own risk. We strongly recommend You explore personal health insurance if you require this type of cover.
  11. Indemnity – You hereby acknowledge this waiver, to release and indemnify all persons, corporations, associations and bodies involved or otherwise engaged in promoting or staging the Event and their servants, agents, representatives, officers and employees. This includes but is not limited to Us, the various committees, members, and employees of all independent contracted suppliers to the event, Course or class, local and regional councils, cities and districts and their respective officers, directors, employees, independent contractors, representatives, agents, volunteers, event organisers and sponsors whether or not the loss, injury or damage is attributed to the act or neglect of any or more of them.
  12. Limitation of Liability – You hereby agree that Pursuit Of Wisdom Martial Arts Australia, Its Directors/Instructors or nominated agent shall not be liable for any loss, damage or personal injury or death suffered by You, whether directly or indirectly arising out of any act of omission by Pursuit Of Wisdom Martial Arts Australia, Its Directors/Instructors or nominated agent.
  13. Our Rights – Any failure on the part of Us to exercise or enforce any right herein shall not constitute a waiver of such right.
  14. Enforceability – If any term or condition herein is held by a court of competent jurisdiction to be contrary to law or unenforceable, then such term or condition may be removed without affecting the remaining terms and conditions, which shall remain in full force and effect.
  15. Modification – We reserve the right to modify these terms and conditions from time to time without notice. It is the responsibility of the participant to check the most current version of the terms and conditions, published on Our Website at https://pursuitofwisdom.com.au/terms .
  16. Membership – You understand that approved Memberships are for a lifetime, unless cancelled by Head Instructor. Approval of Membership will be granted upon a commitment by You to adhere to the policies, procedures, code of conduct and terms and conditions of Pursuit of Wisdom Martial Arts Australia. Memberships can be cancelled by the Head Instructor for any or no reason, however reasons may relate to breaches of conduct, safety or behaviours that put You or those around You at risk. Cancelled memberships are non-refundable and non-transferrable.
  17. Class Etiquette – Students are to present to class at least 10 minutes prior to start time, as not to disrupt class. If attending after the designated start time, wait at the back of the class for an Instructor to bow you in. All students are expected to bow as they enter and exit the training hall / space / dojang, and to all Black Belts and Instructors.
  18. Fees and Payments – You are responsible to keep fees and payments up to date. Weekly payment should be made at the beginning of the first class attended each week. Payments by EFTPOS (Preferred), cash or direct deposit are accepted. A membership can be cancelled at the discretion of the Head Instructors where payments are behind & no arrangements have been entered into.
  19. Financial Hardship and Payment Plans – We understand that it is hard to balance the family budget. If you are experiancing short-term financial hardship, please come and discuss a payment plan with Head Instructor.
  20. Uniforms – Upon approval and payment of membership, a uniform including cross-over jacket, pants, belt & cotton training t-shirt will be issued. It is the responsibility of the student, parent/carer to ensure that the pants of the student are adjusted and hemmed accordingly. Rolled up pants and sleeves present a danger to other students. Students are required to wear their uniform, clean and presentable. Under no circumstances are external club’s uniforms or belts to be worn during class. Uniforms that are outgrown, worn out, lost, stained or damaged require replacement at student’s expense.
  21. Assessment Weeks – Assessments are held mid-term. You will be provided at least 2 weeks’ notice. The full Dobok is required to be worn.
    Progression is determined by a combination of skill, attitude, effort, attendance and assimilation within club culture and is the discretion of the Head Instructor.  Each student is assessed on individual merits. All students will be assessed.
  22. Recognition Of Prior Learning – When transferring from another club all students will be placed at a rank deemed appropriate by the Head Instructor both to challenge them and not to overwhelm them. Every club teaches slightly differently. Expect to be placed at a rank lower than the previous club. This is usually to ensure that students are taught in Our club method before ascending to an authoritative rank.
  23. Photography/Videography – You agree to not take photos or videos without express permission from Head Instructor. We may take photos and videos in class for marketing and promotional purposes. You agree that you allow us royalty-free ownership of all photos and videos. All photography & videography conducted during classes, grading’s or other club occasions remains the property of Pursuit Of Wisdom Martial Arts Australia.
